Copyright complaints

The unauthorized use of the copyrighted works of other parties on this website is permitted under Section 107 of US copyright law which states that “the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include— (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; (2) the nature of the copyrighted work; (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and (4) the effect of the use upon the potential market for or value of the copyrighted work.” However, we will remove copyrighted work upon genuine request unless the used portion of the work is nonfictional (e.g., a claim about personality), including claims about the real world or real people or rational, intellectual, or moral claims even if within a fictional work; OR unless the used portion of the work is of the topic or subject itself (such as a quote from a book or author within an article about that book or author). Please contact us with proof of copyright and ownership or authorization thereof.

Plagiarism

Section 102(b) of US copyright law excludes the purely intellectual content of a work from copyright stating “In no case does copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle or discovery, regardless of the form in which it is described, explained, illustrated or embodied in such work,” which belongs instead to the “public domain” through a form of idea-expression distinction (learn more about why public domain matters). Therefore, we will not remove any content to which this applies. As a breach of ethical conduct, if you believe any intellectual content has been plagiarized (improperly attributed, as derived, paraphrased, or quoted, with consideration of common knowledge, citations, links, and our “Sources and Versions” in each respective model’s menu), please contact us to let us know so we can review and rectify if true.

Marks

PersonalityTapestry™, Pultrait™, Affectemper™, Cognitype™, HumanityTapestry™, theTapisery™, and a/the Tapiser(s)™ are unregistered suggestive trademarks protected by common law rights. You may not use the same or similar marks for the same or similar providers or provisions unless in reference to us. This includes but is not limited to slight or mistakable alterations (e.g. “Personal Tapestry”), such as with spacing, possessives, or plurals (e.g. “PersonalityTapestries”). Note that intellectual terms for ideas or models by definition or synonym or relation such as of personality (identity, selfhood, psyche, etc.), triadic (trivariate, triune, tripartite, threefold, etc.), pulsion/pulsive (behavior, lifestyle, instinct/ual, etc.), trait (prevalence, predominance, continuum, spectrum, scale, etc.), affect/affective (feeling, worldview, emotion/al, etc.), temper (precedence, preference, priority, proportion, ratio, etc.), cognition/cognitive (thought, process, cerebral, etc.), and/or type (presence, category, dichotomy, etc.) are inalienably public domain and cannot be trademarked or even copyrighted. You may not attempt to trademark generic intellectual nomenclature (e.g. triadic personality) or closely related descriptions (e.g. “Triune Psyche”). For your own marks, you must create an “inherently distinctive” fanciful, arbitrary, or suggestive mark by metaphor, portmanteau, etc., such as we have. Learn more at USPTO trademark basics.
